Eterbook is a place for remembrance. We believe that memories should be treated with care — and so should the information people share with us.

This Privacy Notice explains how Eterbook collects, uses, stores, shares and protects personal information when you visit or use Eterbook.

Eterbook is operated by a company incorporated in the State of Delaware, United States. We aim to respect applicable privacy and data-protection laws wherever Eterbook is used, including applicable laws in the United States, the European Economic Area, the United Kingdom and other jurisdictions.

2. What information we collect

We try to collect only the information reasonably necessary to provide and protect Eterbook.

Candles and messages

When you light a candle or leave a message, you may provide:

  • your name or initials;
  • the message you choose to publish;
  • your country or location, if you choose to provide it.

You do not need to provide more personal information than is necessary for the feature you are using. Please do not include sensitive or private information about yourself or other people in a public message unless you are comfortable with that information being published and have the right to share it.

Memorials

When you create a memorial, we process the information and content you choose to add. This may include:

  • a person's name;
  • dates or other biographical information;
  • photographs;
  • memories, stories or messages;
  • other information or materials you choose to publish.

A memorial may contain information about a deceased person as well as information about living people. We encourage memorial creators and contributors to respect the privacy of living individuals and not publish personal information that they do not have the right to share.

Email addresses

We collect your email address only when you choose to provide it. For example, you may provide an email address when:

  • requesting an anniversary reminder;
  • requesting access to or management of a memorial;
  • using a memorial recovery or handover feature;
  • contacting Eterbook;
  • making a privacy or removal request.

We use your email address for the purpose for which you provided it and for reasonably related service, security or administrative purposes.

Technical information

When you access Eterbook, our systems may automatically process limited technical information necessary to operate and secure the service. This may include:

  • IP address;
  • browser and device information;
  • date and time of requests;
  • technical identifiers;
  • information about interactions with our service;
  • security and abuse-prevention information.

We may use an IP address or information derived from an IP address to detect and prevent spam, fraud, abuse and unauthorized activity. Where appropriate, we may convert an IP address into a hashed or otherwise pseudonymized security identifier and discard the original IP address for that particular purpose. A hashed or otherwise pseudonymized identifier may still constitute personal information under applicable law.

3. How we use information

We use personal information for purposes including:

  • providing and operating Eterbook;
  • creating and maintaining memorials;
  • displaying candles, messages and other content;
  • allowing memorial creators to manage their memorials;
  • sending reminders and other communications that you request;
  • responding to questions and support requests;
  • processing privacy and removal requests;
  • preventing spam, fraud, abuse and unauthorized access;
  • protecting the security and integrity of Eterbook;
  • maintaining and improving the service;
  • complying with applicable law;
  • establishing, exercising or defending legal rights.

We do not use personal information for unrelated purposes simply because we have received it.

4. Advertising and sale of personal information

Eterbook is a remembrance service, not an advertising marketplace.

We do not:

  • sell personal information to data brokers or advertisers;
  • rent personal information to advertisers;
  • build advertising profiles from memorial activity;
  • use memorial content to create advertising audiences;
  • display targeted advertising on memorial pages.

We do not use personal information for unrelated commercial purposes simply because it has been provided to us. If our practices change in the future, we will update this Privacy Notice and provide any notice, choice or consent required by applicable law.

5. Public and private memorials

Eterbook may offer public and private memorial options.

Public memorials

A public memorial is intended to be accessible to visitors to Eterbook. Information that you choose to publish on a public memorial may therefore be viewed, copied, shared or otherwise used by other people. Please consider carefully what you publish.

Private memorials

A private memorial is intended to have limited visibility. Where a private memorial is offered, we use technical measures designed to prevent ordinary public discovery and search-engine indexing. However, no online service can guarantee absolute confidentiality. A person who obtains a valid access link, credential or other authorized means of access may potentially be able to access a private memorial. Private memorials are not intended to be publicly searchable.

6. Cookies and similar technologies

Eterbook may use cookies and similar technologies. Some cookies or similar technologies may be necessary for the operation of the service. For example, Eterbook may use a technical browser cookie or similar identifier to allow you to manage a memorial without creating a traditional user account.

Other technologies, such as optional analytics or advertising technologies, may be subject to consent or other requirements depending on applicable law. We do not use advertising cookies on memorial pages to create targeted advertising profiles. For more information, please see our Cookie Notice.

7. Legal bases

Where applicable law requires us to identify a legal basis for processing personal information, we may rely on:

  • providing a service you have requested;
  • our legitimate interests in operating and securing Eterbook;
  • preventing spam, fraud and abuse;
  • complying with legal obligations;
  • protecting our legal rights;
  • your consent, where required.

Where processing is based on consent, you may withdraw your consent at any time. Withdrawal does not affect the lawfulness of processing that occurred before the withdrawal.

8. Service providers and sharing

We may use trusted service providers to operate Eterbook. These may include providers of:

  • hosting and cloud infrastructure;
  • data storage;
  • email delivery;
  • security and abuse prevention;
  • technical infrastructure;
  • customer support.

These providers may process personal information on our behalf and only as reasonably necessary to provide their services to Eterbook.

We may also disclose personal information when reasonably necessary to:

  • comply with applicable law;
  • respond to lawful legal process;
  • protect the safety, rights or property of Eterbook or others;

9. International processing

Eterbook is operated from the United States and is intended to be available internationally. Your personal information may therefore be processed in the United States or in other countries where Eterbook or its service providers operate. Those countries may have privacy laws that differ from the laws of your country. Where applicable law requires specific safeguards for international transfers, we will use legally recognized transfer mechanisms.

10. How long we keep information

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Notice, unless a longer period is required or permitted by law. In general:

  • Memorial content is retained while the relevant memorial remains active, unless removed earlier.
  • Candles and messages are retained while they remain part of the relevant memorial or service, unless removed earlier.
  • Email addresses are retained for as long as reasonably necessary to provide the feature or service for which they were provided.
  • Security and abuse-prevention information is retained only for as long as reasonably necessary to protect the service, investigate incidents and meet legal requirements.
  • Information required for legal purposes may be retained for the period required or permitted by law.

When information is no longer needed, we will delete it, anonymize it, or otherwise dispose of it securely, subject to reasonable backup, security and legal retention requirements.

11. Your privacy rights

Depending on where you live and which privacy laws apply to you, you may have some or all of the following rights:

  • the right to know whether we process your personal information;
  • the right to access personal information we hold about you;
  • the right to correct inaccurate or incomplete information;
  • the right to request deletion;
  • the right to request restriction of processing;
  • the right to object to certain processing;
  • the right to receive certain information in a portable format;

  • the right to opt out of certain uses of personal information where provided by applicable law;

These rights are not absolute and may be subject to legal exceptions. For example, we may need to retain certain information to comply with law, protect the security of Eterbook, prevent fraud or abuse, or establish or defend legal claims.

12. Removing information from Eterbook

You may request removal of:

  • a memorial you created;
  • a candle or message you submitted;
  • personal information about you;
  • content that you believe violates your privacy rights;
  • other content where you have a valid legal or privacy basis for removal.

To protect users against unauthorized deletion or disclosure, we may ask for reasonable information to verify your request or your connection to the relevant content. We will process valid requests within the time required by applicable law.

13. Information about living people

Eterbook exists primarily to remember people who have died. However, memorials may contain information about living people, including family members, friends, contributors or other people mentioned in memories.

We ask users to respect the privacy of living people. Please do not publish sensitive personal information about another living person unless you have a legitimate reason and the right to do so.

14. Security

We use reasonable technical and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration or disclosure. No internet service can guarantee absolute security. If we become aware of a security incident affecting personal information, we will respond in accordance with applicable law.

15. Children's privacy

Eterbook is not directed toward children. We do not knowingly collect personal information from children where applicable law prohibits such collection or requires parental consent. 16. Automated systems

Eterbook may use automated technical systems to detect spam, fraud, malicious activity or other abuse. We do not use personal information to make decisions about individuals that produce legal or similarly significant effects through solely automated decision-making.

17. United States privacy rights

Privacy laws in the United States vary by state. Depending on your state of residence and whether the applicable law covers Eterbook, you may have rights concerning your personal information, including rights to access, correct, delete or obtain information about certain processing activities. Some state laws may also provide rights to opt out of targeted advertising, certain forms of profiling, or the sale or sharing of personal information.

20. United Kingdom

You may also have the right to complain to the Information Commissioner's Office. Where required by applicable law, we will provide additional information concerning our UK representative, international transfers and other UK-specific requirements.

If you are located outside the United States, European Economic Area or United Kingdom, the privacy laws applicable in your country may provide additional rights. We will respect those rights where they apply to our processing.

22. Changes to this Privacy Notice

We may update this Privacy Notice from time to time. We may update it when:

  • Eterbook introduces a new feature;
  • our technology or data practices change;
  • we begin using a new service provider;
  • privacy laws or regulatory requirements change;
  • we improve the clarity or accuracy of this Notice.

The latest version will always be published on this page. If a change materially affects how we use personal information, we will provide additional notice where required by applicable law.
